THIS AGREEMENT CONTAINS A MANDATORY ARBITRATION CLAUSE AND A WAIVER OF CLASS ACTION RIGHTS, WHICH LIMIT YOUR LEGAL RIGHTS. PLEASE READ THIS AGREEMENT CAREFULLY.

Healthy Balance provides a variety of services focused on supporting individuals in achieving weight loss goals, specifically through medical consultations and prescription medications, including semaglutide and tirzepatide. These services are offered to individuals who meet our eligibility requirements. This Agreement (“Terms” or “Agreement”) sets forth the legally binding terms and conditions governing the use of the Platform and the Services.
By accessing or using any part of the Platform, you acknowledge that you have read, understood, and agree to comply with these Terms. If you do not agree with any of the Terms, you are not authorized to use the Services.

- Prescriptions: Based on the results of consultations, healthcare providers may prescribe weight loss medications such as semaglutide and tirzepatide, when deemed appropriate.

IV. ELIGIBILITY
To use Healthy Balance Weight Loss services, you must meet the following requirements:

- Be in good general health and eligible to use weight loss medications as determined by your healthcare provider.
You agree to keep your information up to date and provide truthful and accurate details. If any of the information you provide is found to be inaccurate or incomplete, we may suspend or terminate your access to the Services.
V. MEDICAL DISCLAIMERS
The Services provided by Healthy Balance Weight Loss are not intended to replace medical advice, diagnosis, or treatment from your primary healthcare provider. While our healthcare providers may prescribe medications like semaglutide or tirzepatide, the decision to use these medications is based on their professional evaluation.
You agree to seek advice from your primary healthcare provider before making any medical decisions. Healthy Balance Weight Loss is not responsible for any medical conditions that arise, including any adverse effects related to medications prescribed through our service.
If you experience any medical emergencies, you must immediately seek assistance from emergency medical services.
VI. PAYMENT AND SUBSCRIPTION TERMS
Healthy Balance Weight Loss operates on a subscription-based model. By enrolling in our Services, you agree to the following payment and billing terms:
- Subscription Model: Users will be charged on a monthly or recurring basis depending on the plan selected at enrollment. Details of your plan and pricing will be provided during registration.
- Payment Authorization: By entering your payment details, you authorize Healthy Balance Weight Loss to charge your payment method for the applicable subscription fees and any associated costs.
- Refund and Cancellation Policy:
- You may cancel your subscription within 30 days from your initial payment to receive a full refund for that billing cycle.
- After 30 days, no refunds will be issued, but you will retain access to the Services for the remainder of the current billing cycle.
- You may cancel your subscription by contacting our support team.
We reserve the right to modify our pricing at any time, and any such changes will be communicated to you in advance.
VII. PRIVACY AND DATA USE

You acknowledge that by agreeing to arbitration, you waive the right to a jury trial and to participate in any class action lawsuit. Any arbitration will be conducted on an individual basis, and claims cannot be joined with those of other users.
XI. LIMITATION OF LIABILITY
Healthy Balance Weight Loss and its affiliates are not liable for any damages arising from the use or inability to use the Services, including any adverse reactions to medications or treatments prescribed. Our liability is limited to the total amount you have paid for the Services in the 12 months prior to the occurrence of the event giving rise to the claim.
We are not liable for any incidental, indirect, special, or consequential damages, including those related to lost profits, data loss, or medical complications.
XII. MODIFICATIONS TO THE SERVICES
Healthy Balance Weight Loss reserves the right to modify, suspend, or discontinue the Services or any part thereof at any time, with or without notice. If any changes to the Services are made, we will notify you in advance, and you may choose to accept or reject the changes.
